The Deregulation Act 2015 – Tenancy Deposits
The case of Superstrike has been clarified under the Deregulation Act which received Royal Assent on 6th March 2015. The Deregulation Act confirms that any deposits received prior to 6th April 2007 where the tenancy has been renewed or becomes statutory periodic after 6th April 2007 must be protected in one of the three statutory schemes and the prescribed information issued to the tenant. Legionella Guidance – Rented properties
Landlords must be aware of their responsibilities to ensure that the risk of exposure to legionella in rented properties is controlled and precautions taken to minimize the risk of exposure. The Deregulation Act 2015 – Section 21 Notice
The Deregulation Act provides a provision for a prescribed s21 form to be introduced and now under the Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations 2015 a prescribed section 21 notice must be used for all tenancies granted on or after 1st October 2015. A prescribed form cannot be issued to the tenant within the first four months of the original tenancy so effectively landlords or agents will not need to serve the notice until February 2016 for tenancies created.; ….. Smoke and Co2 Alarm Regulations 2015
The Smoke and Carbon Monoxide Alarm (England) Regulations 2015 have been approved by parliament and are due to come into effect on 1 October 2015. Private sector landlords are required from 1 October 2015 to have at least one smoke alarm installed on every storey of their properties and a carbon monoxide alarm in any room containing a solid fuel burning appliance (e.g. a coal fire, wood burning stove). Landlords and the Immigration Act 2014
New provisions will require landlords (and by implication, agents) to carry out immigration checks on all tenancies starting after the introduction date. The pilot areas are Birmingham, Walsall, Sandwell, Dudley and Wolverhampton. A nationwide introduction date has not yet been set, however rollout to the Waveney Valley area is expected imminently.
